Overview
This website, hearthwire.shop (the "Site"), is operated by Nook and Node LLC ("HearthWire," "we," "us," or "our"), based in Southern California, United States. By visiting the Site or buying from us, you agree to these Terms of Service (the "Terms"), along with our Shipping Policy, Refund & Returns Policy, and Privacy Policy, which are part of these Terms. If you don't agree, please don't use the Site.
Our store is hosted on Shopify. Payments are processed securely through Shopify Checkout.
Eligibility
You must be at least the age of majority in your state, province, or country of residence (or have permission from a parent or guardian) to use the Site and place orders. You agree to provide accurate, current, and complete information when you place an order or create an account, and you are responsible for keeping your account login secure.
Products, descriptions, and pricing
We try to describe and display our products as accurately as possible. Colors and details may look slightly different depending on your screen, and products from our fulfillment partners may vary slightly from photos. If a product isn't as described, your remedy is set out in our Refund & Returns Policy.
All prices are in US dollars (USD). Prices, products, and availability may change at any time without notice. If an item is listed at an incorrect price because of an error, we may cancel the order and refund you in full, even after the order is confirmed.
Orders and payment
Placing an order is an offer to buy. We may accept, limit, or cancel any order, including orders that appear fraudulent, are placed by resellers, or exceed quantity limits. If we cancel an order after you have been charged, we'll refund you in full.
We accept payment through Shopify Checkout, including Visa, Mastercard, American Express, Discover, Diners Club, Shop Pay, Apple Pay, and Google Pay. You confirm that you are authorized to use the payment method you provide. Applicable taxes are shown at checkout.
Discount codes
Discount codes, such as our first-order code WELCOME15 (15% off), are subject to any conditions shown when the offer is made. WELCOME15 is limited to one use per new customer. Unless stated otherwise, codes have no cash value, can't be applied to past orders, and may be changed or ended at any time. We may cancel orders that misuse a code.
Shipping, returns, and refunds
Shipping is governed by our Shipping Policy, and returns, refunds, exchanges, and cancellations are governed by our Refund & Returns Policy. Many items are shipped directly by our fulfillment partners, and some partner items are fulfilled through Shopify Collective. Delivery dates are estimates and are not guaranteed.
Third-party services and links
The Site may use or link to third-party services (such as Shopify, payment providers, carriers, and fulfillment partners). We aren't responsible for third-party websites or services, and your use of them may be subject to their own terms and privacy policies.
Acceptable use
You agree not to use the Site for any unlawful purpose; to interfere with its security or operation; to upload viruses or malicious code; to scrape, copy, or collect data from the Site using automated means without our permission; or to impersonate anyone or submit false information. We may suspend or end your access if you break these Terms.
Intellectual property
The Site and its content, including the HearthWire name and logo, text, graphics, images, product descriptions, and design, are owned by or licensed to HearthWire and are protected by intellectual property laws. You may not copy, reproduce, sell, or use our content for commercial purposes without our written permission. Third-party brand names and trademarks (for example, Anker) belong to their respective owners.
If you send us feedback or suggestions, we may use them without any obligation to you.
Disclaimer of warranties
Except as stated in our policies or as required by law, the Site and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions don't allow the exclusion of implied warranties, so some of these exclusions may not apply to you. Any manufacturer warranty that comes with a product is provided by the manufacturer.
Limitation of liability
To the fullest extent permitted by law, HearthWire and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site or any product. Our total liability for any claim related to an order will not exceed the amount you paid for that order.
Nothing in these Terms limits or excludes liability that can't be limited or excluded by law, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.
Indemnification
You agree to defend and hold harmless HearthWire and its owners, employees, and partners from claims, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site, to the extent permitted by law.
Governing law and disputes
These Terms are governed by the laws of the State of California and applicable US federal law, without regard to conflict-of-law rules. If you have a concern, please contact us first; most issues can be resolved quickly by email. Any dispute that can't be resolved informally will be handled in the state or federal courts located in California, unless the law where you live gives you the right to bring a claim in your local courts. Nothing in this section limits your rights under applicable consumer protection laws.
Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted on this page, and the "Effective date" above will change. The Terms in effect when you place an order apply to that order. Continuing to use the Site after changes are posted means you accept the updated Terms.
Severability and entire agreement
If any part of these Terms is found unenforceable, the rest stays in effect. These Terms, together with our Shipping Policy, Refund & Returns Policy, and Privacy Policy, are the entire agreement between you and HearthWire about your use of the Site. Our failure to enforce any part of these Terms is not a waiver.
